🧠 What Could Happen After the Midterms
If Democrats win a majority in the House of Representatives in the midterm elections later this year:
✔️ Congress could open oversight investigations into Trump’s conduct while in office, including actions related to elections, executive power, or federal enforcement decisions. Congressional committees have broad powers to hold hearings, gather evidence, and issue subpoenas. �
✔️ Some House Democrats and candidates have expressed interest in investigating Trump and his administration’s behavior, though party leaders have been cautious about promising impeachment because they want to focus on winning elections. �
✔️ A Democratic-controlled House could pursue impeachment again, but even if that happens, a Senate must vote to convict — and the Senate would need a 2/3 majority to remove a sitting president. That’s a high bar and may not be possible even with a Democratic House alone.

It’s important to understand the difference:
📍 Impeachment and removal from office is a political process done by Congress.
📍 Criminal prosecution is a legal process done by courts after (or apart from) someone leaving the presidency.
Federal prosecutors have looked into actions by Trump in the past — including his efforts to overturn the 2020 election and how he handled classified documents. There were indictments and investigations led by Special Counsel Jack Smith, but those cases were dismissed when Trump was reelected because of Department of Justice policy not to prosecute a sitting president. �
Once Trump is no longer president, or if new evidence emerges, prosecutors at the federal or state level could pursue criminal cases against him — as long as they follow legal rules, constitutional protections, and due process.
